The offer and sale of the Products through the website www.hotrealdolls.com (“the Website”) shall be governed by these General Terms and Conditions of Sale.

- INFORMATION ON THE SELLER

The Products are manufactured by third-party suppliers and manufacturers duly selected: the SELLER is available to provide the contact detail of the said suppliers and manufacturers upon the purchaser’s request.
- FORMATION OF THE SALE CONTRACT
You can purchase the Products through the Website as a “guest” or as a registered user.
In order to register to the Website you have to fill in the registration form after having carefully read the information to data subjects and the information notice concerning the use of cookies. You shall duly keep confidential and protect the authentication credentials to the Website. The SELLER shall not be responsible for any use of the authentication credentials by third party or for any fraudulent use.
Purchases of Products through the Website are allowed to users who have already turned 18.
If you want you submit an order for the purchase of one or more Products you shall access the Website (for registered users by using the authentication credentials we sent you after your registration to the Website), fill out the purchase order and send it through the Website to the SELLER, following the relevant instructions.
Before transmitting the purchase order form you will be able to check it and correct any mistake using the shopping bag and then amending, erasing, adding the selected Products. By sending the purchase order you expressly accept and confirm these General Terms and Conditions of Sale.
The languages available for the conclusion of a contract with SELLER are Italian and English.
The purchase order will include a summary of these General Terms and Conditions of Sale, information concerning the essential characteristics of the Products and the related price, the payment terms, the delivery terms and costs.
The contract shall be deemed to enter into force once you will receive SELLER’s order confirmation by email.
In the event the purchaser order data are not complete you won’t be able to send the order.
In the event that Products are no longer available, SELLER will promptly inform you by email that the contract is not concluded, explaining the reasons thereto. If you have already paid the price of the Products, SELLER will reimburse the relevant amount.
The Products are customized and manufactured solely according to your requests. Therefore, you are entitled to withdraw the order only within and not later than twenty-four (24) hours as of the date and time of the purchase; in such a case you will be reimbursed of the amount paid less Euro 150.00 (one hundred fifty) for administrative reasons. After the twenty-four-hour term you shall not be entitled to withdraw or amend the order for any reason whatsoever.
The purchase order and the relevant contract will be stored on our data base during the execution of the order and in any case for the term provided for by the applicable law in order to comply with the contractual obligations. You may check the purchase orders submitted at any time by using your Account (only for registered users).

- PRICE AND PAYMENT TERMS
The price of each Product (VAT, taxes and customs duties – if any - included) is specified in the related product sheet.
You may pay by using one of the following payment methods:
- Credit card by PayPal credit card processing. On the Website payment page select “Pay with credit card or Visa”. You will not be requested to have a PayPal account in order to pay with credit card. The payment may be done using more than one credit card in the event the credit of one card is not sufficient.
- Payment with PAYPAL account. On the Website payment page select the orange button “PayPal check out” at the end of the page. Access to your PayPal account in order to pay. When you pay using your PayPal account you are protected by PayPal purchase protection term.
- Payment by bank wire transfer. If you pay in advanced by bank wire transfer the Products ordered will be kept in stock until the related amount is credited on SELLER bank account, which in any case shall occur within 7 days as of the date on which the order was accepted. If the sums due are not credited within 7 days as of the date on which the order was accepted, the order shall be deemed null and void. All information related to this payment method are specified in the SELLER’s email for order confirmation.

- MANUFACTURE AND DELIVERY OF THE PRODUCTS
The Products are manufactured and delivered in 3 weeks on average as of the date of the SELLER’s email for order confirmation; you should then receive the Product within 4 weeks as of the date of the order.
Within 3-5 days as of the SELLER’s email for order confirmation, we will inform you on the date of completion of the production. The SELLER will timely inform you on any delay on the above-mentioned terms due to high demands or for production reasons.
The SELLER will send you a picture or video during the quality inspection. This procedure is carefully made to ensure that the Product meets your requests. Please inform us within12 hours as of the delivery of the picture or video in the event of inconsistencies with your requests, in order to remedy them.
Within 48 hours as of the delivery we will send you the tracking number. The Product will be delivered through UPS Air Express or FedEX Air Express service to the address specified in the SELLERS’ email for order confirmation.
SELLER shall not be held liable for any late delivery due to the forwarding agent and/or to force majeure.
The Product will be delivered with discretion on an unmarked package. Your signature will be requested for the delivery. If available, you contact the appointed carrier and pick up the Product at the carrier’s premises. All information are available using the tracking number.
- DELIVERY COSTS
Delivery of the Products is free of charge and includes importation taxes and customs duties for the following countries: USA: United Kingdom, Germany, France, Poland, Czech Republic, Austria, Slovakia, Italy, The Netherlands, Belgium, Denmark, Bulgaria, Estonia, Luxemburg, Sweden, Lithuania, Croatia, Romania, Spain (Canary Islands, Ceuta and Melilla excluded), Portugal (Portuguese Azores islands and Madeira excluded), Northern Ireland, Finland, Greece. For any other country delivery cost may be added. Contact us for any information. The delivery costs are detailed in the order summary available on the Website prior to the confirmation and sending of the order.

- CHECKING OF THE PRODUCTS
Upon receipt of the Product it is your responsibility to check that the package is intact, free from damage and not wet and in any case that the seal has not been tampered with. You shall immediately inform the carrier of any damage.
Once the carrier’s documents have been signed, you will no longer be entitled to claim anything about the external characteristics of the product delivered.
Should the delivered Product not correspond with the Products ordered, you shall immediately notify the SELLER by email info@hotrealdolls.com.
- WARRANTY FOR DEFECTS
According to articles 130 of Decree 206/2005 as amended, the SELLER is responsible for any lack of conformity on the Product for a period of two (2) years as of the date of delivery.
You may request and buy an additional warranty before sending the order to have a three-year warranty term.
Subject to the loss of warranty, you shall notify the SELLER using the relevant form available on the Website or in writing by means with proof and date of receipt any vice and lack of conformity on the Product within two (2) months as of the date of the relevant discovery.
Should the complaints raised by you during the warranty period be grounded and accepted by SELLER, the latter shall remove the defect or replace the defective Product (or the component). Should the repair or replacement of the Product is impossible or disproportionate, you may ask for an appropriate reduction of the price or terminate the contract and the amount paid will be reimbursed to you.
he warranty obligation set forth herein are binding on the SELLER only if the latter has the opportunity to examine the vice and lack of conformity.
The warranty is expressly excluded for vices and/or defects of the Products arising from or consisting in:
- any repair, alteration and/or modification made by third party not authorized in writing by SELLER;
- improper use of the Product, which shall include failure to observe the rules set forth in the instructions delivered with the Products;
- normal wear and tear of the Product and or components or materials;
- water or liquid infiltration;
- power supply not in compliance with the safety standards;
- any other cause not due to the SELLER’s negligence.
Ferma restando l’applicazione delle norme in materia di responsabilità per danno da prodotti difettosi, e l’eventuale responsabilità in caso di dolo o colpa grave, il VENDITORE non sarà responsabile per i danni diretti o indiretti che l’acquirente e/o terzi dovessero subire a causa dei difetti del Prodotto.
Il VENDITORE è disponibile per assistenza via email o telefonica dal lunedì al venerdì dalle ore 15 alle ore 17.
Gli aggiornamenti del software sono sempre gratuiti e disponibili previa richiesta al Venditore.
- RIGHT OF WITHDRAWAL EXCLUSION
According to article 59 § 1 lett. c) 2 of the Decree 206/2005 as amended the right of withdrawal is excluded being the Products customized or made according to the purchase requests.
- APPLICABLE LAW – DISPUTE RESOLUTION
For any matter not covered by these General Terms and Conditions of Sale the applicable law shall be the Italian law.
For any dispute concerning the sale of the Products through the Website:
- For consumers living in EU the parties may reach an out-of-court settlement through the Online Dispute Resolution platform (https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=EN). For the said online dispute resolution procedure and for any information or request SELLER contact email address is info@hotrealdolls.com;
- For consumers NOT living in EU the parties may reach an out-of-court settlement through the online dispute resolution service “Risolvionline” (http://www.risolvionline.com/index.php?lng_id=14).
In the event the parties fail to reach an agreement through the above-mentioned online dispute resolution procedures, then the dispute shall be submitted to the court where the consumer has his/her domicile.

- LIMITATION OF LIABILITY
SELLER may at any time amend the contents off the Website, interrupt or limit the Website functions in order to carry on maintenance or solve technical issues, disable user’s account and authentication credentials in the event of fraudulent use of the Website or breach of these General Terms and Conditions of Sale. SELLER shall not be liable in case you are not able to access the Website or send the purchase order for the following reasons: force majeure, break-down or malfunctioning of SELLER’s hardware, malfunctioning of the internet services.
